Terms of Service

These Terms are an agreement between you and Xoan Martinez (“BlockCrew,” “we,” “us”), who runs SnowCrew and the other BlockCrew apps (the “apps”). By creating an account or using any of the apps, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the apps. Section 18 says that disputes with us are settled by individual arbitration instead of in court, unless you opt out. Please read it.

1. Who can use BlockCrew

You must be at least 16 years old, live in the United States, and be able to agree to these Terms. If you’re under 18, you may only use BlockCrew with the permission of a parent or legal guardian, who agrees to these Terms for you and is responsible for your use of BlockCrew; Stripe will also ask for their details before paying you. You agree to give accurate information, keep it up to date, keep your password private, and have only one account. You’re responsible for everything done with your account.

2. What BlockCrew is (and isn’t)

BlockCrew is a marketplace. Our apps, starting with SnowCrew, let people who need work done at their home, like clearing snow (“customers”), post jobs, and let people who want to do that work find and book them. In SnowCrew they’re called “shovelers,” and these Terms use that word for anyone who does a job through the apps. BlockCrew itself does not clear snow or provide home services.

Each job is an agreement between the customer and the shoveler. We are not a party to that agreement, except for handling payments as described in section 8. We don’t supervise, direct or control how, when or whether a shoveler does a job.

3. Shovelers are independent

Shovelers are independent contractors, not employees, agents, partners or joint venturers of BlockCrew. Shovelers decide which jobs to take, when to work, what equipment to use and how to do the work, and can use other apps or work for anyone else.

Shovelers are responsible for their own equipment, transportation, safety, insurance, taxes, and for following all laws that apply to them, including any local licensing rules. Shovelers get no wages, benefits or insurance from BlockCrew.

4. No background checks and no guarantees

We do not run background checks on users, inspect properties, or check anyone’s skills, equipment or insurance. Stripe, our payment partner, verifies some identity details before a shoveler can be paid, but that is not a background check.

We don’t guarantee that a job will be booked, that a shoveler will show up or finish on time, the quality of any work, or that anything another user says is true. Use your own judgment about who you deal with.

5. Safety and the risks of snow removal

Snow removal can be dangerous. Risks include slips and falls, cold exposure, overexertion, injuries from shovels, snow blowers and other equipment, moving vehicles, falling ice, and damage to property such as cars, lawns, walkways, fences and landscaping. You understand these risks and choose to take them. To the fullest extent the law allows, you take full responsibility for them.

Customers: describe the job honestly, tell the shoveler about hazards you know of (like ice, steps, hidden objects or pets), keep pets and people safely away from the work, and only post jobs at a property you have the right to authorize work on.

Shovelers: only take jobs you can do safely, use proper clothing and equipment, stop if conditions are unsafe, and never climb onto roofs or do work that needs special training or licensing.

Any injury or property damage connected to a job is a matter between the customer and the shoveler. BlockCrew is not responsible for it, except where the law says otherwise.

6. Posting, booking and doing jobs

Customers must describe each job accurately, including what needs clearing, its size and the correct address. Before a job is booked, other users see only the street name, a rough area on a map and the approximate distance. The exact address is shared with the shoveler who books the job.

Shovelers must take a “before” photo when they arrive and an “after” photo when they finish, and should only mark a job finished when all the listed work is done. Customers should check the work and either approve it or explain what still needs doing.

Don’t put gate codes or other sensitive details in the job notes; send them in the chat after the job is booked.

When posting, customers choose “as soon as possible” or a time the job must be done by, up to 5 days ahead. A shoveler who books an as-soon-as-possible job must start within 2 hours; a shoveler who books a scheduled job must start before its deadline. Shovelers can have up to 3 jobs booked or in progress at once. If a job includes salt, the shoveler brings and spreads it.

7. Cancellations

Customers can cancel a job before the work starts. Cancelling before a shoveler books is free. After a shoveler books, cancelling is free for the first 5 minutes, and free if the shoveler hasn’t started by the time they were supposed to. Otherwise a cancellation fee applies (currently $10, or the job’s price if that’s lower), which is paid to the shoveler, and the rest is refunded. Once the work has started, the job can’t be cancelled.

Shovelers can back out of a booked job before they start it, and the job goes back on the board. If a shoveler doesn’t start in time, the job goes back to other shovelers, or is cancelled with a full refund if the customer’s deadline has passed. Not starting in time, or backing out after the start time, counts as a missed job, and 2 missed jobs in 30 days pause a shoveler’s ability to book jobs for 2 weeks. We may also limit, pause or close accounts with repeated cancellations, missed jobs or complaints.

We may cancel jobs that break these Terms, that we think may be fraudulent, or whose payment fails. Jobs that nobody books within about 6 days, or before the customer’s deadline, expire and are cancelled automatically.

Blocking the other person on a booked job that hasn’t started cancels it (if you’re the customer) or takes you off it (if you’re the shoveler), under the rules above. A job that’s already underway carries on.

8. Payments

Payments are processed by Stripe. Customers pay the job price set in the app plus a service fee (currently 15% of the price), both shown before you post. When you post a job, we place a hold on your card for the total. Your card is charged when a shoveler books the job.

If the job is cancelled or expires before anyone books it, the hold is released. If it’s cancelled after booking but before the work starts, you get your money back, minus any cancellation fee described in section 7. Refunds and released holds can take several business days to show up, depending on your bank.

After the shoveler marks the job finished, the customer can approve it or send it back with a note. If the customer doesn’t respond within 3 days, the job is approved automatically and the shoveler is paid. Raising a job’s price places a new hold for the new total. Tips are optional and 100% of each tip goes to the shoveler.

Shovelers keep 100% of the job price they agreed to, plus tips and any cancellation fee. BlockCrew uses Stripe to make payouts to shovelers. The Stripe Recipient Agreement (stripe.com/connect-account/legal/recipient) applies to your receipt of those payouts. To receive payouts from BlockCrew, you must set up payouts with Stripe and provide BlockCrew accurate and complete information about you, and you authorize BlockCrew to share it and information about your payouts with Stripe. Payouts reach your bank on Stripe’s schedule.

Promo codes can reduce the service fee, never a shoveler’s pay. Each code has its own limits (for example, first job only), has no cash value, and may expire or be withdrawn at any time.

If a payment is disputed or reversed (a “chargeback”), looks fraudulent, or is connected to a breach of these Terms, we may hold, reverse or cancel related payouts and refunds while we look into it, and may recover amounts owed from future payouts where the law allows.

All amounts are in US dollars. We may change the service fee in the future; any change applies only to jobs posted afterwards and is shown before you post. Each user is responsible for their own taxes. We and Stripe may report payments to tax authorities where required, and may ask shovelers for tax information.

Don’t arrange to pay or be paid outside BlockCrew for a job you found through BlockCrew. Payments outside the app aren’t protected by the hold, approval or refund process.

9. Problems between users

If something goes wrong with a job, first try to sort it out with the other person in the chat. You can also contact us, and we may try to help. We aren’t required to resolve disputes between users, but when money is involved we may decide in our reasonable judgment whether to approve, refund or hold a payment, and that decision is final as far as BlockCrew is concerned. This doesn’t take away any legal rights you have against the other user.

10. Your content

You keep ownership of the photos, messages, job descriptions and other things you add to BlockCrew (“your content”). You give us a worldwide, royalty-free license to store, copy, display and use your content to run and improve BlockCrew, show it to the other people on your jobs, help resolve disputes, keep people safe and enforce these Terms. This license lasts as long as we keep your content as described in the Privacy Policy.

After a job, customers and shovelers can rate each other. Ratings must be honest and about the job. Your average rating, and the number of jobs you’ve finished as a shoveler, are shown to other users. We may remove ratings, photos, messages or anything else that breaks these Terms.

Only share content you have the right to share. Job photos should show the area being cleared, not people’s faces, license plates or the inside of homes where you can avoid it. Don’t share anyone else’s personal information outside the job it belongs to.

11. Things you must not do

Don’t use BlockCrew to: break any law; harass, threaten, discriminate against or harm anyone; post fake jobs, fake photos or false information; use a stolen card or someone else’s account; commit fraud or money laundering; avoid our fees by moving a job off the app; contact other users for anything other than their jobs; do work while impaired by alcohol or drugs; or interfere with the app, including by scraping, reverse engineering, overloading it, or getting around our security or privacy protections (such as trying to work out someone’s exact address before booking).

We have zero tolerance for abusive users and objectionable content. You can report or block anyone from their job or from your chat with them. We review reports within 24 hours, remove content that breaks these Terms, and suspend or close the accounts of people who post it or who harass others.

12. Suspending or closing accounts

We may warn you, limit your account, cancel jobs, or suspend or close your account at any time if we believe you broke these Terms, created risk or legal exposure for us or others, or for any other reason permitted by law. You can stop using BlockCrew at any time and delete your account from the Account tab. Sections that by their nature should continue (like payments owed, disclaimers, limits on liability, indemnity and dispute resolution) still apply after your account is closed.

13. Disclaimers

BlockCrew is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the app will be uninterrupted, error-free, secure, or that maps, addresses, distances or weather-related timing are accurate. We aren’t responsible for the conduct of any user, on or off the app.

14. Limits on our liability

To the fullest extent the law allows, BlockCrew and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, or for any personal injury, death or property damage arising from any job or from the conduct of any user, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for all claims relating to BlockCrew or these Terms is limited to the greater of (a) the service fees you paid BlockCrew in the 12 months before the claim arose, or (b) $100.

Some places don’t allow some of these limits, so they may not all apply to you. Nothing in these Terms limits liability that can’t legally be limited.

15. Release

To the fullest extent the law allows, you release BlockCrew and its owners, employees and contractors from all claims, demands and damages of every kind, known or unknown, arising out of or connected with disputes between you and other users, or any job. If you are a California resident, you waive California Civil Code section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

16. Indemnity

You agree to defend, indemnify and hold harmless BlockCrew and its owners, employees and contractors from any claims, losses, damages, fines and costs (including reasonable lawyers’ fees) arising from your use of BlockCrew, any job you post, book or do, your content, your breach of these Terms, or your violation of any law or anyone else’s rights.

17. Other services we use

BlockCrew relies on other companies, including Stripe for payments, Apple and Google for maps and directions, and hosting and notification providers. Your use of their services may also be governed by their own terms. We aren’t responsible for their services.

18. Settling disputes with us

Please contact us first at help@blockcrew.us so we can try to resolve any dispute informally. If we can’t resolve it within 30 days, you and BlockCrew agree to resolve it through final and binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either of us may instead bring an individual claim in small claims court if it qualifies.

You and BlockCrew each give up the right to a jury trial and to take part in a class action, class arbitration or other representative proceeding. If this class action waiver is found unenforceable for a claim, that claim must be brought in court, not in arbitration.

You can opt out of this arbitration agreement by emailing help@blockcrew.us within 30 days of first agreeing to these Terms, with your name, the email address on your account, and a clear statement that you opt out of arbitration.

These Terms are governed by the laws of the State of New York and the Federal Arbitration Act, without regard to conflict-of-law rules. Any court case allowed under these Terms will be brought in the state or federal courts located in New York.

19. Apple App Store

If you downloaded BlockCrew from Apple’s App Store: these Terms are between you and BlockCrew, not Apple, and BlockCrew (not Apple) is responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, or intellectual property infringement claims. You confirm you are not in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. Changes to these Terms

We may update these Terms from time to time. If a change is significant, we’ll let you know in the app or by email before it takes effect. Continuing to use BlockCrew after changes take effect means you accept them.

21. Everything else

These Terms and the Privacy Policy are the whole agreement between you and BlockCrew about the app. If any part is found unenforceable, the rest still applies. If we don’t enforce a part right away, we can still enforce it later. You may not transfer these Terms to anyone else; we may transfer them, for example if BlockCrew is moved to a company or sold.
